Possible Breach or Unauthorized Disclosure Complaint Procedure

Parents, eligible students (students who are at least 18 years of age or attending a postsecondary institution at any age), principals, teachers, and employees of an educational agency may file a complaint about a possible breach or improper disclosure of student data and/or protected teacher or principal data. 

Reporting a Complaint

All complaints should be submitted :
  1. in writing to the Data Privacy Officer Bonnie Nobiling, 31 Center Street, Oneonta, NY  13820 
  2. or via the District Unauthorized Disclosure Complaint Form
  3. or via the NYSED Unauthorized Disclosure Complaint Form

Written Complaints must include 
  1. Reporter's Contact information (First Name, Last Name, Phone Number, Email address)
  2. Role/Relationship to Student or Principal 
  3. Your District/Building Affiliation
  4. Possible Improper Disclosure or Breach Information to include: 
    1. Description of the Events, 
    2. Description of Possible Disclosed Data and 
    3. Description of How Reporter Learned of Possible Disclosure.

Response to Complaints

Upon receipt of a complaint, the District will promptly acknowledge receipt of the complaint, commence an investigation, and take the necessary precautions to protect personally identifiable information (PII). 

Following the investigation of a submitted complaint, the District will provide the individual who filed the complaint with its findings. This will be completed within a reasonable period of time, but no more than 60 calendar days from the receipt of the complaint by the District. 

If the District requires additional time, or wherethe response may compromise security or impede a law enforcement investigation, the District will provide the individual who filed the complaint with a written explanation that includes the approximate date when the District anticipates that it will respond to the complaint.
